Welcome to GutLab. These Terms and Conditions govern your use of our website and the purchase of our products. By accessing this website or placing an order, you agree to be bound by these Terms and Conditions, the Consumer Protection Act 68 of 2008 (CPA), the Electronic Communications and Transactions Act 25 of 2002 (ECTA), and other applicable laws of the Republic of South Africa.

If you do not agree with these Terms, please do not use this website or purchase our products.

1. Eligibility & Use of Website

  • You must be at least 18 years old, or have parental/guardian consent, to make purchases from GutLab.

  • You agree to use this website only for lawful purposes and not in violation of any South African law.

  • GutLab reserves the right to refuse service, cancel orders, or restrict access at its sole discretion.

2. Nature of Products & Disclaimer

  • GutLab offers a whole-food gut health formula intended to nourish and support the human gut microbiome.

  • Scientific studies have shown associations between microbiome diversity and systemic health, but:

    • Our products are not medicines.

    • They are not intended to diagnose, treat, cure, or prevent any disease.

    • They have not been evaluated or approved by SAHPRA (South African Health Products Regulatory Authority).

  • Information provided on this site is for educational purposes only and is not a substitute for medical advice.

  • Always consult a qualified healthcare professional before making changes to your diet, especially if you have a medical condition or are on chronic medication.

3. Orders & Payments

  • All prices are listed in South African Rand (ZAR) and include VAT where applicable.

  • Orders are only confirmed once full payment is received and cleared.

  • Accepted payment methods include: Credit/Debit Cards, PayPal, and EFT/Bank Transfer.

  • GutLab reserves the right to cancel any order due to errors, stock unavailability, or suspected fraud.

4. Delivery & Perishable Goods

  • Our products are perishable. Customers must ensure:

    • Correct delivery address and recipient details are provided.

    • Someone is available to receive the package on delivery.

    • Products are placed into a freezer immediately upon receipt.

  • Risk of loss and responsibility for correct storage transfers to the customer once delivery is completed.

  • GutLab is not responsible for spoilage, degradation, or misuse after delivery.

5. Refunds & Returns

  • Due to the perishable nature of our products, refunds are not available once products have been dispatched.

  • Replacements or partial refunds may be issued at GutLab’s discretion if products arrive damaged or spoiled.

  • Claims must be made within 24 hours of delivery and supported by clear photographic evidence.

6. Intellectual Property

  • All content on this website — including logos, text, images, product names, formulations, and designs — is the property of GutLab or its licensors.

  • You may not reproduce, copy, distribute, or commercially exploit any content without prior written consent.

7. Limitation of Liability

  • To the fullest extent permitted by South African law, GutLab shall not be liable for:

    • Any indirect, incidental, or consequential damages arising from the use of our website or products.

    • Any adverse effects caused by improper use, storage, or handling of products.

  • Our maximum liability shall not exceed the purchase price of the product in question.

  • Nothing in these Terms excludes liability for gross negligence or wilful misconduct as defined under South African law.

8. Indemnification

By using this website or purchasing our products, you agree to indemnify and hold harmless GutLab, its employees, directors, and affiliates from any claims, damages, or liabilities arising from your misuse of products, breach of these Terms, or violation of any law.

9. Modifications to Terms & Offerings

  • GutLab reserves the right to update, amend, or modify these Terms at any time without prior notice.

  • Continued use of the website or purchase of products after changes are posted constitutes acceptance of the updated Terms.

10. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of the Republic of South Africa.

  • Any dispute shall first be addressed through good-faith negotiation.

  • If unresolved, disputes may be referred to arbitration in Johannesburg under the Arbitration Foundation of Southern Africa (AFSA) rules, or to the competent courts of South Africa.
